ARVATA'S TERMS OF SERVICE

By purchasing my art services or acquiring my designs/adoptables by any means, you automatically agree to the following conditions.
Please read this entirely and carefully. If there are any questions or concerns, send me a private e-mail or Twitter message.

COMMISSIONED ARTWORK

GENERAL

❖ Commission slots are usually not "first-come-first-serve". I decide whether to accept your order after reading your note. Factors include commission type, complexity, my current queue and how well I think I can work with your idea. To reiterate, your commission MAY be declined, please be understanding of this.

❖ The prices stated on this page may change over time and also may not be final as complexity fees might occur for your piece. Please treat them as "starting" prices and consider the amount of details in your piece if you'd like to stay within a certain budget. Feel free to contact me if you would like a quote!

The prices stated on this page are for personal commissions only. If you are looking for a piece for commercial or non-commercial use e.g. for an external project, something to resell, redistribute, reproduce, use as an ad, for a video, for merchandise etc., ask me for info on commercial prices/royalty fees.

❖ Some of the examples on this page contain elements that are not included in the base price(e.g. "background") and are merely used as artstyle examples. Please refer to the description section of each commission style for accurate information on what's included.

❖ Average completion time of a standard commission(e.g. cel-shaded character with transparent background) is roughly 2 weeks without a queue, however do not rely on this for any deadlines you may have. Estimate at least two months for good measure, longer if the piece is particularly large/complex.

PAYMENT

❖ All payment should be upfront and in USD or NOK. Via PayPal. DeviantArt points are only acceptable as payment if specified by me.
❖ I reserve the right to decide the final price for individual commissions, regardless of pricing stated elsewhere.
❖ All payment should be made through invoice method. I will invoice you. DO NOT send me any payment outside of this invoice.
❖ Payment plan availability must be discussed with me and is not a guaranteed option.

❖ A refund during or prior to the sketch stage contains a 25% deduction for slot occupation. Once a WIP sketch has been approved, or from start if a WIP isn't needed, refunds will become unavailable. Chargebacks are absolutely NOT allowed.
❖Revisions of the artwork, aside from minor edits, is only possible during the sketch stage, during which you may request a WIP for us to discuss.

❖Unfounded revisions, a.k.a. revisions due to a dislike of artstyle, change of mind or failure to specify details during the order will not be granted unless I agree to it, during which I reserve the right to add a fee over the edit. Because of this, please make sure to plan your commission carefully before ordering.

❖Unreasonably high scrupulousness regarding edits is not allowed. Anything that needs to be fixed on my mistake will be fixed for free, but constant and/or unjust demands might lead to a cancellation of the commission.
❖You will receive the full resolution only after the payment is made in full.

PROCESS

Preface. You understand that Arvata is not working with only your priorities in mind. The art process contains steps that are time consuming and slow. Additionally, while they will work hard to make you a custom-tailored quality product, they will not accept a stressful work situation where an unreasonably high amount of edits or updates are demanded. Please do not commission them if you are looking for fast or timely work or if you are extremely critical regarding small details.

❖ Before ordering a commission, please make sure that a commission slot is open and available.

❖ Note me your request privately in either an e-mail or a note on DeviantArt with any necessary information, explaining your idea for the piece.
❖ By paying the invoice through PayPal, you acknowledge that the commission is digital and will not be physically shipped.
❖ After payment is received: I sketch, color and paint depending on your commission type.
❖ Please be reasonably available during the process in the event that further communication is needed.
❖ A full size, small-watermark image will be given of the finished artwork. It is necessary that you use a watermark/resized version of the image before sharing publicly.

THE ARTIST'S RIGHTS/OBLIGATIONS

By commissioning me, you're purchasing my artist labor and only a partial right to a design/art piece. I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce or use the image as a sample for sales/self-promotion.

❖ I will respect your request to not publicly post your commission. No explanation necessary, however you must inform me of this when ordering.
❖ I will not claim the Intellectual Property or reuse/resell the image for personal and commercial projects unless agreed upon.
❖ I reserve the right to reject your commission proposal without question, as well as cancel ongoing commissions.

THE COMMISSIONER'S RIGHTS/OBLIGATIONS

Once a piece is commissioned, you may use it for any personal use that you please, including but not limited to icons, signatures, layouts, wallpapers, themes and personal site display. If you are looking for a piece for either commercial or non-commercial use e.g. for an external project, something to resell, redistribute, reproduce, use as an ad, for a video, for merchandise, to resell at conventions etc., you must specify this to me beforehand for information on commercial prices/royalty fees as well as for a contract to be signed.

❖ You retain the rights to the IP.
❖ The commissioned piece is free for you to use for personal enjoyment.
❖ You may NOT claim the work to be your own, edit, resell or set it up for redistribution.

❖ Without my permission in a signed contract, you may NOT use it for any other external purpose, commercial or non-commercial. Personal use only.

❖ You are not permitted, under any circumstances, to use any part of your commissioned artwork for non fungible tokens. Use of the artwork for any advertising or profits associated with non fungible tokens, blockchains or cryptocurrency is strictly prohibited.

❖ You are not permitted to reproduce and/or otherwise use the commissioned piece in any manner for purposes of training/using artificial intelligence technologies to generate other pieces, including without limitation, technologies that are capable of generating pieces in the same style or genre as the commissioned piece. Nor are you permitted to sublicense others to do this.

❖ Always credit me if displaying the piece publicly.

If you are not sure whether your request counts as personal or commercial, feel free to ask me about its intended use.
